Canon's A1000 IS, A2000 IS, SX110 IS and E1 break free

Here's three more from Canon, the same, entry-level trio we saw leaked yesterday now official (where's the E1?). The optical image stabilized set feature face detection and DIGIC 3 image processing. Let's highlight the differences:
$300 SX110 IS: 9 megapixels, 10x zoom, 3-inch LCD
$250 A2000 IS: 10 megapixels, 6x zoom, 3-inch LCD
$200 A1000 IS: 10 megapixels, 4x zoom, 2.5-inch LCD
All three break loose at the end of this month and ship with a pair of AAs and 32MB SD card.

Sony Xross Fade Dual iPod DJ Dock Is Wiggity Wack

The $500 Xross Fade DJ system is Sony's hard-to-pronounce dual iPod dock kit for mixing songs. It may have some rad-looking bass reflex speakers and dual subwoofers, but it's unfortunately gimped as far as DJ features go—you can cue and crossfade between songs, a technology straight outta 2005 and something you could do on a PC with moderate iTunes skills. There are also some presumably lame-ass drum beats you can lay top of your tracks to spice them up, but not much more. Seriously Sony, what gives? DJing is just no fun without some "wikki wikki". Hands On With the UrbanMax, Intel's Concept Tablet Notebook...Thing

This year's Intel Developer Forum is all about different form-factors, with walls of nearly identical MIDs, way too many netbooks and this strange creature, the Intel UrbanMax concept. The prototype is running a Core 2 Duo (at least for now) crammed into a thin, quasi-tablet case, with an 11 inch N-trig DuoSense capacative multitouch screen and provisions for a WiMax connection built in. The UrbanMax form-factor is a novel take on the old tablet concept, and possibly a superior one. (from http://gizmodo.com/)

Dell E-series netbooks to include 10-incher? Today we hope to find out.

It's time for more Dell E-series netbook rumors, you ready? According to DigiTimes and its industry sources, Compal Electronics is slapping together both 8.9-inch and 10-inch E-series netbooks for Dell. Previously, we've only heard mention of an 8.9-inch E and 12.1-inch E Slim. The 10-inch E is scheduled for an October product launch while the 8.9-incher was previously rumored for August. Interestingly, Dell expects the 10-incher to experience almost twice the demand of the 8.9-inch model (assuming a sole-source manufacturing deal) based on Compal's monthly production estimates of 400k-450k and 250k units, respectively. There's a Dell press event later on today where we might just bring all these Dell netbook rumors to rest. Stay tuned, as they say (taken from http://www.engadget.com/2008/08/12/dell-e-series-netbooks-to-include-10-incher-today-we-hope-to-fi/)

Comcast to Slow Some Web Traffic for Up to 20 Minutes (Update2)

Aug. 20 (Bloomberg) -- Comcast Corp. plans to slow Internet service to its heaviest users during periods of congestion, after regulators ordered the company to devise a new method for managing its Web traffic.
The top Internet speeds for targeted customers will be reduced for periods lasting 10 minutes to 20 minutes, keeping service to other users flowing, Mitch Bowling, Comcast's senior vice president and general manager of online services, said in an interview yesterday.
The U.S. Federal Communications Commission found on Aug. 1 that Comcast had improperly blocked peer-to-peer programs such as BitTorrent that are used to share videos and other files. In an order posted on its Web site today, the FCC gave the Philadelphia-based company 30 days to provide details of its ``unreasonable network management practices'' and show how they would be changed by year-end.
''We're going to really have to see all the detail and have all the information,'' Marvin Ammori, general counsel for the non-profit group Free Press, said in an interview. Free Press, which promotes universal access to communications, and another organization, Public Knowledge, filed the complaint that resulted in the FCC censure.
The new system will move away from a focus on specific applications that hog Web traffic, Bowling said. Comcast will determine ``in nearly real time'' whether congestion is caused by a heavy user, he said.
''If in fact a person is generating enough packets that they're the ones creating that situation, we will manage that consumer for the overall good of all of our consumers,'' Bowling said.

Managing Traffic

Comcast, which reported 14.4 million Internet users at the end of the second quarter, fell 21 cents to $21.28 at 4 p.m. New York time in Nasdaq Stock Market trading. The shares have gained 17 percent this year.
Free Press and Public Knowledge, both based in Washington, told the FCC in a Nov. 1 complaint that Comcast ``is secretly degrading innovative protocols used for transporting and sharing large files, like high-quality television programming and movies.''
The FCC acted ``to protect consumers' access to the Internet,'' FCC Chairman Kevin Martin said in an Aug. 1 interview.
Comcast has decided to use the new system, which it calls ``fair share,'' and will fine-tune it further before introducing it, Bowling said.

Pricing Decision
The company is considering whether to charge subscribers more for heavier Internet use, a step announced by some other cable companies, Bowling said. Time Warner Cable Inc., the second-largest U.S. cable company, started testing metered pricing in Beaumont, Texas.
``I think everyone's looked at something,'' Bowling said. ``We haven't made any decisions.''
In trials, Comcast has found the fair share system to be effective if the slowing lasts for ``roughly between, probably, 10 and 20 minutes,'' Bowling said. The user's Internet speed would then return to normal.
``If they continue that, we would have to manage them again,'' Bowling said.
A user being impeded would have Internet speeds equivalent to ``a really good DSL experience,'' Bowling said. DSL, or digital subscriber line, is an Internet service offered by telephone companies. (http://www.bloomberg.com/apps/news?pid=20601087&sid=aCyJNA18k1dY&refer=home)

Fujitsu Siemens Amilo Mini coming soon?

It looks like Fujitsu Siemens could be launching its Amilo Mini netbook in a few weeks. The company is holding a press event on August 28th at the IFA trade show in Berlin, and IDG News says it’s likely that Fujitsu Siemens will likely discuss the notebook at that point.

While a few pictures and videos of the Amilo Mini have been making the rounds, there’s not a ton of information about the machine available. It’ll pack an Intel Atom CPU, 1.3MP webcam, run Windows XP, and cost between 300 and 400 Euros. The only things that seem to set it apart from the dozens of other netbooks hitting the market are the fact that the Amilo Mini will have changeable faceplates in multiple colors including brown, black, pink, and red. LivePlace To Launch Photo-Realistic Virtual World Rendered In The Cloud

LivePlace.com has posted a video displaying a very impressive render of a 3D virtual world called City Space. At this point very little is known about LivePlace, other than that the WHOIS lists the domain’s owner as Brad Greenspan, one of the co-founders of MySpace. Note: It appears that in the 20 minutes since I spoke to Greenspan about this post, someone was told to take LivePlace down (apparently nobody was supposed to find it).

The other nugget of information found in the video is that the game is running on OTOY, the 3D engine that renders graphics in the cloud. The technology allows relatively weak computers (or even mobile phones) to display incredibly detailed graphics comparable to those seen in Hollywood movies.

The video shows a massive virtual city filled with towering skyscrapers, parks, user-customized apartments and houses, public meeting places, subways, and everything else you might expect in a metropolitan area, all beautifully rendered by the OTOY engine. The game also features impressive real time lighting, reflection, and weather effects that rival those seen in detailed 3D games (and even some movies).

At this point it appears that gameplay will be focused on human avatars, who can own their own living spaces and offices, buy and sell goods at a virtual mall, and interact with each other in public places.

While there are a number of online games that offer impressive graphics (though none of this caliber), the real potential behind LivePlace and the OTOY engine is the cloud-based rendering engine, which allows games on almost any computer to play without needing a powerful graphics card. OTOY has been developed to work in any browser without a plugin, which makes the barrier for entry into this virtual world much lower than Second Life. Of course, we have no idea when City Space will actually launch, so it’s far to early to hail it as the second coming of social online worlds.

Update 2: According to this comment, portions of the video are taken from an artist’s portfolio that may not be related to LivePlace (the video he linked to is identical to the first 10 seconds of the clip above). It’s possible that the artist works for LivePlace, but it certainly doesn’t sound like it was rendered in real time…(from http://www.techcrunch.com/2008/08/11/liveplace-to-launch-photo-realistic-virtual-world-rendered-in-the-cloud/)

Some Web Firms Say They Track Behavior Without Explicit Consent

Several Internet and broadband companies have acknowledged using targeted-advertising technology without explicitly informing customers, according to letters released yesterday by the House Energy and Commerce Committee.

And Google, the leading online advertiser, stated that it has begun using Internet tracking technology that enables it to more precisely follow Web-surfing behavior across affiliated sites.

The revelations came in response to a bipartisan inquiry of how more than 30 Internet companies might have gathered data to target customers. Some privacy advocates and lawmakers said the disclosures help build a case for an overarching online-privacy law.

"Increasingly, there are no limits technologically as to what a company can do in terms of collecting information . . . and then selling it as a commodity to other providers," said committee member Edward J. Markey (D-Mass.), who created the Privacy Caucus 12 years ago. "Our responsibility is to make sure that we create a law that, regardless of the technology, includes a set of legal guarantees that consumers have with respect to their information."

Markey said he and his colleagues plan to introduce legislation next year, a sort of online-privacy Bill of Rights, that would require that consumers must opt in to the tracking of their online behavior and the collection and sharing of their personal data.

But some committee leaders cautioned that such legislation could damage the economy by preventing small companies from reaching customers. Rep. Cliff Stearns (R-Fla.) said self-regulation that focuses on transparency and choice might be the best approach.

Google, in its letter to committee Chairman John Dingell (D-Mich.), Markey, Stearns and Rep. Joe L. Barton (R-Tex.), stressed that it did not engage in potentially the most invasive of technologies -- deep-packet inspection, which companies such as NebuAd have tested with some broadband providers. But Google did note that it had begun to use across its network the "DoubleClick ad-serving cookie," a computer code that allows the tracking of Web surfing.

Alan Davidson, Google's director of public policy and government affairs, stated in the letter that users could opt out of a single cookie for both DoubleClick and the Google content network. He also said that Google was not yet focusing on "behavioral" advertising, which depends on Web site tracking.

But on its official blog last week, Google touted how its recent $3.1 billion merger with DoubleClick provides advertisers "insight into the number of people who have seen an ad campaign," as well as "how many users visited their sites after seeing an ad."

"Google is slowly embracing a full-blown behavioral targeting over its vast network of services and sites," said Jeffrey Chester, executive director of the Center for Digital Democracy. He said that Google, through its vast data collection and sophisticated data analysis tools, "knows more about consumers than practically anyone."

Microsoft and Yahoo have disclosed that they engage in some form of behavioral targeting. Yahoo has said it will allow users to turn off targeted advertising on its Web sites; Microsoft has yet to respond to the committee.

More than a dozen of the 33 companies queried said they do not conduct targeted advertising based on consumers' Internet activities. But, Chester said, a number of them engage in sophisticated interactive marketing. Advertisers on Comcast.net's site, for instance, are able to target advertising based on "over 3 billion page views" from "15 million unique users." Systemwide GMail Outage

Since about 2 p.m. Pacific Time today, many Gmail users have been unable to access their email. We are very sorry for this interruption in service. The issue is being caused by a temporary outage in the contacts system used by Gmail which is preventing Gmail from loading properly. We are starting to roll out a fix now and hope to have the problem resolved as quickly as possible. Even though you may not be able to get to your inbox right now, your mail is safe, including new incoming messages. We will post an update in the Gmail Help Center (http://mail.google.com/support/) when more information is available.

Gmail is having a systemwide outage affecting multiple countries, and a whole bunch of its 100 million users are screaming about it on Twitter. Around 20 million people visit Gmail each day, according to Comscore, and they're all seeing the same message. The first outages were reported at about 2 pm PST, 44 minutes ago. The Gmail blog is silent on the outage, instead giving readers some useful tips on customizing web clips.

We're waiting on Google for a comment on the reason for the outage, but I can't help but suspect that my decision yesterday to abandon MobileMe/.Mac in favor of the super-stable Google apps may have been a factor. Sometimes Google does things just to spite me.

Meanwhile, the productivity of 20 million people worldwide just spiked upward. Thanks to Todd Garland for the creative image. (http://www.washingtonpost.com)

It's Microsoft v Nintendo In Third-Party Sales Spin WAR

Brace for PR spin motion sickness! If you care to remember, Nintendo found themselves caught ankle-deep in a public relations tarpit last week, when they made some claims about third-party sales without the proof to back it up. A few days later they did provide the proof - in the form of some NPD sales data - but now that they have, Microsoft have called baloney. Rubbish. It's Super Soakers at ten paces. MS PR man David Dennis says "No matter how you slice it, the Wii third party game story is not a pretty one", and points to his own NPD sales, which show that 67,929,999 third-party games have been sold on the 360, compared to the Wii's 33,394,311. But Dennis, those are lifetime sales! The Nintendo graph clearly showed only the first 19 months of each console's lifespan! Excuse us while we have a quick lie down, this PR spin is making us dizzy. Online Threats Cost Consumers $8.5 Billion Over Last Two Years

Consumer Reports cites security problems as a main motivation for buying a new PC or Mac and also lists what it considers to be the seven most common online blunders.

By Thomas Claburn
InformationWeek
August 4, 2008 09:00 PM

Consumers have lost almost $8.5 billion over the last two years to viruses, spyware, and phishing attacks. But computer security problems have been good for the computer business -- consumers replaced some 2.1 million computers because of malware infections.

Consumer Reports published these findings in its September issue as part of its annual State of the Net survey. The data is based on a survey of 2,071 online households conducted by the Consumer Reports National Research Center.

Among other notable data points: Consumers have a 1 in 6 chance of being victimized by cybercrime, down from a 1 in 4 chance in 2007; 19% of respondents said they didn't have antivirus software on their computers; and 75% of respondents said they didn't have an anti-phishing toolbar.

Consumer Reports also lists what it considers to be the seven most common online blunders. These include failing to keep antivirus software up to date; clicking on e-mail links to access financial Web sites; using a single password for all online accounts; downloading free software; assuming that Macs are safer than Windows PCs; clicking on "scareware" pop-up ads that claim your computer is at risk; and shopping online without taking extra precautions.

Consumer Reports' issue with Macs is that Mac users fall for phishing scams at about the same rate as PC users, yet fewer of them use anti-phishing toolbars than PC users. Because Apple's Safari Web browser does not have built-in phishing protection, Consumer Reports recommends using the most recent versions of Firefox or Opera instead of Safari, as well as trying a free anti-phishing toolbar like McAfee Site Advisor or FirePhish.

However, falling for a phishing scam could be characterized as more of an issue of user gullibility than of platform or application security. And despite singling out faith in the protective power of Macs as one of its seven online blunders, Consumer Reports noted, "As in our past surveys, very few Macintosh users reported so much as a single virus or spyware infection."

The magazine also has some kind words for Microsoft's Windows Vista operating system. It says that Windows Vista users were "significantly less likely to report a spyware infection and less likely to report a virus infection than other Windows users."

Dell Seeks, May Receive 'Cloud Computing' Trademark

The company now has six months to file a statement of use -- a document backing up or solidifying Dell's use of the term cloud computing -- or request for extension.

Like the term Web 2.0, "cloud computing" is quickly becoming a meme without borders.

And like the old one, the new phrase with the fuzzy definition (is it software as a service, or utility computing, or anything served over the Internet, or none of the above, or all?) has someone making a claim on its trademark, as Dell (Dell) filed for a trademark on the term last year.

Dell's trademark filing is for computer and networking hardware design, customization and development as well as consulting services for "data centers and mega-scale computing environments." The filing, published in April 2007, is now in the "notice of allowance" stage, which means it has been approved but not yet formally registered. The trademark filing is filed under the filing basis 1B, which means it hadn't yet been used but that Dell intended to do so when filing.

Last year, Dell introduced a new cloud computing business called Dell Cloud Computing Solutions, aimed at providing hardware, consulting and planning to Web companies that require highly scalable data centers. Recently, Dell founder and CEO Michael Dell told BusinessWeek cloud computing would soon be a $1 billion business for the company. Among its early customers is Ask.com.

The company now has six months to file a statement of use -- a document backing up or solidifying Dell's use of the term cloud computing -- or request for extension. Otherwise, it will have abandoned the application. A Dell spokesman said the company will decide within these six months if it intends to press forward, but gives no indication which way the company leans. The application has already passed the period when opponents could come out against it.

It's possible the trademark could still be rejected if found that someone else used it before Dell's filing date, or if the term was in popular general use, and someone sued Dell with those claims. Though filing documents show that Dell did a search for prior use, there are commercial references to cloud computing on the Web before April 2007. For example, Google CEO Eric Schmidt also used the term in reference to the more general term in remarks to investors a month earlier. According to a Dell spokesman, Dell always does appropriate due diligence around adoption and use of its IP.

The trademark application was recently noted by cloud computing consultant Sam Johnston, posting on a Google (NSDQ: GOOG) Groups cloud computing forum. Dell has also snatched up the Web sites cloudcomputing.com, cloud-computing.com, and cloud-computing.net as well as cloudcomputers.com. Cloudcomputing.com re-routes visitors to Dell's Cloud Computing Solutions Web site.

Dell's efforts to trademark the term "cloud computing" echo an earlier episode surrounding the term "Web 2.0," which is now a registered trademark of United Business Media, InformationWeek's parent company. Web 2.0 is trademarked in reference to live events and conferences. After the Web 2.0 trademark had been filed (but not yet registered), some controversy temporarily erupted on the Web when a networking group for IT professionals received a cease and desist letter after attempting to set up the "Web 2.0 Half Day Conference" in 2006.

UBM hosts the annual Web 2.0 Summit and Expo in cooperation with the O'Reilly Group and had filed the trademark in 2003. O'Reilly group founder Tim O'Reilly has said that neither his company nor UBM are asserting a claim to every use of the phrase Web 2.0. And despite the earlier cease and desist letter, non-UBM Web 2.0 conferences continue, such as Silicon Valley WebGuild's Web 2.0 Conference & Expo earlier this year. The leader of that conference was also served a cease and desist notice, but put on the conference anyway and was not sued.

InformationWeek's full report on cloud computing including the strategies of Amazon (NSDQ: AMZN), Google, Salesforce.com, and five other leading vendors can be downloaded here (registration required).

Dell isn't the first to attempt to trademark "cloud computing." In 1997, NetCentric Corporation also filed, though that claim is now dead. NetCentric's claim was on educational events about computer and communications networks.

Microsoft Calls Firefox Competitor To Windows

The report shows that Microsoft is aware of its own important balancing act as the company strives to maintain its relevance and dominance in the services era.

Microsoft always paints a picture of the competitive landscape in when it files its annual 10-K report to the Securities and Exchange Commission. In a sign of the times, Mozilla Firefox makes a repeat appearance as a threat to the Windows client business, Microsoft's biggest cash cow.

"The Windows operating system faces competition from alternative platforms and new devices that may reduce consumer demand for traditional personal computers," the report warns, noting the possibility that software as a service and mobile devices could decrease the relevance of traditional PC operating systems. "Competitors such as Mozilla offer software that competes with the Internet Explorer Web browsing capabilities of Windows products. User and usage volumes on mobile devices are increasing around the world relative to the PC."

Firefox has been a success story against Internet Explorer, continually increasing its share against Microsoft's market browser for the last few years. The repeat -- and newly prominent -- appearance on the list of threats to Windows shows that Microsoft is aware of its own important balancing act as the company strives to maintain its relevance and dominance in the services era.

Microsoft has been spending billions on huge new data centers around the world, as recently as last month announcing a new one in Iowa. It's making major investments in search and advertising, has expanded consumer services, and has begun rolling out business services and will likely announce plans later this fall to compete with companies like Amazon.com in utility computing services.

"The ability to combine the power of desktop and server software with the reach of the Internet represents an opportunity across every one of our businesses," the company said. "As we continue to build out our services platform, we will bring a broad range of new products and service offerings to market that target the needs of large enterprises, small and medium-sized businesses, and consumers."

Still, Microsoft makes it clear in its report that much of the increase in revenue the company has seen in the last two years has continued to come from Windows. Preinstalled Windows copies account for more than 80% of Microsoft's client division's revenues, and more PCs sold around the world means more Windows copies sold as well. Microsoft characterized Windows Vista adoption in the last year as "widespread."

Whether that means Microsoft's operating systems are continuing to be well accepted is another matter entirely. Microsoft has begun embarking on a new marketing strategy for Vista 18 months after it was released, trying to convince people that they should buy it despite early criticism. It also recently lashed out at Forrester Research for what it said were "schizophrenic" reports on Vista's adoption rate.

In other competitive notes, Microsoft leaves Citrix off a long list of competitors to its server and tools business, which includes both Windows Server and Microsoft's Visual Studio development tools. Citrix increasingly competes with the group's virtualization products and isn't listed despite VMware's presence. Microsoft and Citrix have had a long partnership around Citrix Presentation Server, which is now known as XenApp.

Microsoft continues to up the ante in research and development, spending $8.2 billion in fiscal 2008. That's a 14% increase over the previous year's $7.1 billion investment, which itself represented 14% more than 2006. Still, all that spending doesn't represent all of Microsoft's investment in new technology, as the company spent $8.8 billion in 21 acquisitions last year, including $5.9 billion on advertising giant aQuantive and $1.3 billion on enterprise search company Fast Search & Transfer.

Amazon.com To Buy Online Bookseller AbeBooks

Amazon said it plans to have the seller of out-of-print books continue as a standalone operation based in Victoria, British Columbia.

Amazon (NSDQ: AMZN).com on Friday said it has agreed to buy AbeBooks, an online marketplace for mostly used, rare, and out-of-print books. Financial terms were not disclosed.

Privately held AbeBooks, based in British Columbia, Canada, lists books from thousands of independent sellers worldwide, Amazon said. The online marketplace has more than 110 million books for sale.

"As a leader in rare and hard-to-find books, AbeBooks brings added breadth and expanded selection to our customers worldwide," Russell Grandinetti, VP of books for Amazon, said in a statement.

The transaction is expected to close before the end of the fourth quarter. Amazon plans to have AbeBooks continue as a standalone operation based in Victoria, British Columbia. It will maintain all of its Web sites, including the ones in Canada with Canadian content, such as reviews of Canadian-authored books and interviews with that country's writers.

So far this year, Amazon has bought online fabric store Fabric.com and audiobook seller Audible. Fabric.com, based in Marietta, Ga., expands Amazon's offerings in the growing craft and hobby marketplace.

A recent report by Jeffrey Lindsay, analyst for Wall Street firm Sanford C. Bernstein, argued that Google and Amazon are in the best position to withstand the current economic downturn and become long-term winners on the Internet.

His report, "U.S. Internet: The End Of The Beginning," also argued that Yahoo (NSDQ: YHOO) would eventually be sold to Microsoft (NSDQ: MSFT); IAC InterActiveCorp, which owns a number of travel, financial, and other commerce sites, would be split five ways as planned; and eBay (NSDQ: EBAY) would become a merger target, the Reuters news agency reported.Information Week

Big Holder Capital Research Wants Yahoo Vote Probe

One of Yahoo's largest and most critical shareholders, Capital Research Global Investors, said Monday it had asked for a probe of last week's shareholder vote.

One of Yahoo's largest and most critical shareholders, Capital Research Global Investors, said Monday it had asked for a probe of last week's shareholder vote, a move that calls into question the strong showing for Chief Executive Jerry Yang.

Yang has been under pressure for months over failed negotiations to sell the company to Microsoft and regarding questions about his leadership, but Friday's shareholder vote suggested the tide was turning in his favor.

News of questions over the vote was first reported by the D: All Things Digital blog. AllThingsD cited unnamed sources saying two major Capital Research and Management funds holding about 16 percent of Yahoo shares had recommended withholding their votes in favor of Yang in protest over his performance.

Capital Research Global Investors, the fund group led by portfolio manager Gordon Crawford, was more strongly opposed to Yang than its sister fund, Capital World Investors, which was less critical, according to sources quoted by AllThingsD.

Yang received 85.4 percent support in the results announced Friday, with the remaining votes withheld in protest.

"I guess Jerry Yang didn't come out of the meeting as unscathed as it seemed," Canaccord Adams analyst Colin Gillis said of the uncertainty raised by calls for a recount.

Investors holding nearly 76 percent of Yahoo's 1.38 billion shares gave solid support for all nine board directors, with the lowest level of support for long-time board member Arthur Kern, who drew 77.9 percent.

Sanford C. Bernstein analyst Jeffrey Lindsay said informal polling his firm had done among major investors showed widespread dissatisfaction with Yahoo's handling of talks with Microsoft, which the broker expected to translate into a more substantial number of withheld votes for directors.

"We were surprised at the very high vote counts that were pro Jerry Yang," Lindsay said. "Certainly the final results seemed very different from the exit polls."

Yahoo said in a statement it was not party to any errors that may have been made in the voting process.

"The independent inspector of elections certified the results of the election and Yahoo accurately announced those results," the company said in an e-mailed statement.

But Yahoo left open the possibility that some intermediary may have made a mistake.

"Yahoo did not participate in the execution of the votes and was not a party to any errors which may have been made either by a voting institution or a proxy processing intermediary acting on behalf of banks, brokers and institutions," it said.

Crawford, whose Capital Research Global Investors owned 6.2 percent of Yahoo as of early June, said in May he was "extremely angry" at Yang over the breakdown of talks with Microsoft. Capital World Investors held 9.8 percent of Yahoo shares, according to recent regulatory filings.

A Capital Group spokesman said the Crawford-run fund had inquired with Broadridge Financial Solutions, a financial services intermediary that handles proxy processing services for it.

"Capital Research Global Investors asked Broadridge Financial to double-check the votes it transmitted to Yahoo on its behalf," said Chuck Freadhoff, a spokesman for the Capital Group and its affiliates. The spokesman declined to comment on how Capital-affiliated funds had cast their votes.

Broadridge declined to comment.

Gillis at Canaccord Adams said a somewhat lower vote was unlikely to materially weaken Yang's position, which looks secure unless Yahoo's third-quarter results fall short amid a worsening economy or if the stock remains stuck around $20 in the months to come.

"I think Jerry (Yang) is still firmly in place until some deviation happens from the plan Yahoo has set forth," he said. (Additional reporting by Muralikumar Anantharaman in Boston; Editing by Toni Reinhold and Braden Reddall) Information Week

Internet Companies Agree On China Code Of Conduct

U.S. technology giants Microsoft, Google, and Yahoo, in talks with other Internet companies and human-rights groups, have reached an agreement on a voluntary code of conduct for activities in China and other restrictive countries, the Wall Street Journal reported on Tuesday.

ug 5 - U.S. technology giants Microsoft, Google, and Yahoo, in talks with other Internet companies and human-rights groups, have reached an agreement on a voluntary code of conduct for activities in China and other restrictive countries, the Wall Street Journal reported on Tuesday.

In separate letters sent to Democratic Senator Richard Durbin, and Republican Senator Tom Coburn, the companies said the code's details were being worked out, the paper reported.

Senators Durbin and Coburn had asked for an update out of concern that without such a code, Internet companies could be pressured by China's government to provide information about Internet users who are in China for the Olympics, the paper said.

Google, Yahoo, and Microsoft did not immediately return calls seeking comment. The voluntary code will spell out "principles of freedom of expression and privacy" in countries where governments seek users' private information or block access to certain Web sites, the paper said, citing the letters.

The code will be completed later this year, the paper reported. (Reporting by Tenzin Pema in Bangalore, editing by Will Waterman)Information Week

Microsoft To Counter Open Source With 'Basic' Software Line

The software vendor plans to develop versions of its products with "basic functionality" to be sold at lower prices than its standard offerings.

In response to rising competition from open source software that's community developed and often given away for free, Microsoft said it plans to develop versions of its products with "basic functionality" to be sold at lower prices than its standard offerings.

Once the sole domain of self-styled computer geeks, open source software, such as Linux, is now used in products offered by a growing number of large tech companies, such as Google, IBM, and Motorola. Those companies believe they can earn more revenue by selling add-ons and services around the software than they could by charging for the software itself.

Microsoft says it's a growing threat to its commercial software business.

"Open source software vendors are devoting considerable efforts to developing software that mimics the features and functionality of our products," Microsoft said in its annual report, filed last week with the Securities and Exchange Commission.

Indeed, IBM last year introduced Lotus Symphony, a free desktop suite that provides much of what's found in Microsoft's pricey Office package. IBM says that hundreds of thousands of users have downloaded Lotus Symphony, which is built on the open source OpenOffice.org package, since its debut.

Open source software also is encroaching on Microsoft's Windows Mobile business, which provides an operating system for cell phones. The LiMo Foundation, which comprises several major mobile device manufacturers and offers an open source OS for phones, earlier this week announced 11 new members and said that Motorola and NEC have introduced new LiMo-based models.

Earlier this year, Symbian -- which owns 65% of the mobile OS market -- adopted the open source model following a buyout by Nokia.

Microsoft said it plans to meet the open source challenge head-on. "In response to competition, we are developing versions of our products with basic functionality that are sold at lower prices than the standard version," the company said in its annual report.

To date, however, Microsoft's low-cost efforts are still relatively expensive, particularly when compared with software that's free. For instance, the student and home versions of Microsoft Office 2007, which a company spokesperson cited Monday as an example of Microsoft's strategy to counter open source products, are both priced at more than $100. Microsoft's Equipt software subscription service, also cited by the spokesperson, sells for $69 per year.

Still, Microsoft believes its low-cost products are sufficiently inexpensive to keep the majority of its customers away from the no-cost competition. "Microsoft has developed lower-priced offerings tailored to customer demand and will continue to do so in the future," the spokesperson said.Information Week
